Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Étudy application ("App") operated by Benedikt Koch ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Use of the App

Étudy is a jazz music education and community platform. You may use the App for personal, non-commercial purposes in accordance with these Terms. You must be at least 13 years of age to create an account.

2. Account

You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to provide accurate information when creating your account.

3. Subscriptions

Étudy Pro is an auto-renewable subscription that provides access to premium features including curated collections, theory analysis, all keys trainer, progressive tempo training, unlimited practice plans, and unlimited saves.

Pricing: The subscription is offered on a monthly basis. The current price is displayed in the App before purchase and may vary by region. Prices are subject to change.

Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase. The subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Managing Subscriptions: You can manage or cancel your subscription at any time through your device's subscription settings (Settings → Apple ID → Subscriptions on iOS, or Google Play Store → Subscriptions on Android).

Free Trial: If a free trial is offered, the unused portion of any free trial period will be forfeited when you purchase a subscription.

4. User-Generated Content

You may create and share jazz licks, transcriptions, and other musical content through the App. You retain ownership of content you create. By sharing content publicly, you grant us a non-exclusive, worldwide license to display and distribute that content within the App.

You agree not to post content that is offensive, illegal, infringes on intellectual property rights, or violates these Terms. We reserve the right to remove content that violates these Terms.

5. Intellectual Property

The App, its design, features, and original content are owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute the App or its content without our permission.

The App is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

9. Changes to Terms

We may update these Terms from time to time. The "last updated" date will reflect the current version. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the jurisdiction of the courts in Cologne, Germany.
